Taylor Family Association (TFA)—Conditions of Use Agreement
Summary: This agreement is essentially a covenant that members of the TFA or members of their families will only use the information provided to the TFA or provided by the TFA for family history and genealogy purpose.
The information will not be used for commercial gain or exploited by TFA members or those of their families. Persons breaking the agreement will be barred from the association and links to the TFA data and maybe subject to legal action.
This website, www.taylorassociation.org, and genealogical database are owned and operated by The Joseph Taylor Senior Family Association, a nonprofit entity (hereinafter referred to as “TFA”). TFA is very sensitive to the privacy of living individuals whose data is contained on our site or databases and limits access to such data to only those individuals who agree to keep such information confidential and limit its use as outlined below. You must agree to abide by the terms of this Conditions of Use Agreement (the “Agreement”) before you will be permitted to register to use the content or make submissions. Laura will address Agreement questions and concerns with the TFA board.
Registration Obligations In consideration for the use of the TFA website, www.taylorassociation.org, or its genealogical database, you represent that you have read and agreed to the terms of this Agreement. If you submit personal information, you agree to:
- Provide true, accurate, current, and complete information about yourself (as indicated during the registration process);
- Maintain and keep current and accurate this information about yourself, should it ever change. If you provide false, inaccurate, inappropriate, or libelous information or images, TFA may suspend or terminate your access to the site.
Only those with valid registrations that demonstrate they are descendants or have a clear connection by marriage or adoption to the Joseph Taylor Sr. family line will be permitted access to living information n this site, and access and use will be subject to agreeing to the Restrictions on Use requirements below.
License to Use In consideration for TFA permitting your use of the sites and genealogical data, and allowing you to submit data to the site or database, you:
A) Give TFA permission to use any genealogical data that you submit on deceased individuals and to copy and distribute it throughout the world by any means TFA deems appropriate without compensation to you of any kind;
B) Give TFA permission to use any genealogical data that you submit on living individuals, provided such living data is only shared with individuals who are registered users of the site and agree to the Restrictions on Use outlined below. Subject to these restrictions, you grant TFA an unrestricted, royalty-free, worldwide, perpetual license to any copyright, author’s right, database right, or similar right that you may hold in your contributed data, and you also grant TFA the right to create derivative works by combining your data with that of other contributors.
With regard to living information, you understand and agree that TFA can provide living data for certain family lines to designated family line coordinators to maintain, manage, correct, add to and verify family history information for a “slice” of the TFA genealogical database. TFA further shares information, including such living data, with those that are part of that same family line for their individual family pedigree research. “Slice” refers to direct descendants of specific individuals, and those that marry in or are adopted into those family lines.
Collaboration with Others You acknowledge that a primary purpose of this site and the TFA genealogical database is to enable collaboration between all authorized users who wish to expand their knowledge of their Taylor ancestral lines. You acknowledge that TFA may utilize genealogical data that you submit relating to deceased or living persons for the purpose of collaborating with others in order to further the Taylor family pedigree for the purpose of increasing participation in family history and preserving the Taylor family records. You acknowledge that collaboration allows TFA to obtain additional data that may be provided freely to all users of this site and stored data, thus allowing family members to extend their own ancestral lines.
Ownership of Materials and Restrictions on Use All material on this site is owned or licensed by TFA. When you submit any information to the site, as outlined above, you understand and agree that you are granting TFA a royalty-free, irrevocable, worldwide, non-exclusive, transferable license to those materials. Once you register on the site and your registration is accepted, TFA authorizes you to view, download, and print material and information from these sites only for your personal, noncommercial use. You are not authorized to distribute or publish the information on this site or from the database to any other website (even a personal website if it is publically accessible) or applications without our prior express written consent.
You may include the information of deceased individuals taken from this site in publications about individuals within a pedigree line, for example, publication of a family genealogical history—but you may only include information on living individuals taken from this site with TFA’s prior written permission and the permission of the living individual.
You may not use this site or information found at this site (including the names and addresses of those who submit information or living data of individuals found on the site) for selling or promoting products or services, soliciting clients, or any other commercial purpose.
TFA reserves the right, in its sole discretion, to deny, revoke, or limit use of this site or genealogical database to any person for any or no reason. TFA is not responsible for any use that you make of materials from this site, and you agree to fully indemnify TFA for any claims against TFA that arise from your actions. In no case does TFA guarantee that materials on this site or genealogical database are legally available for any use beyond personal, noncommercial genealogical research.
Right to Submit Whenever you submit data to TFA, you are affirming that you have the legal right to contribute that data to us and to grant TFA the rights set out in this Agreement. You accept legal responsibility for TFA’s use of your contributed data based on your affirmation. You are solely responsible for all content that you contribute and post to this site.
Care of Submissions TFA intends to use reasonable efforts to preserve the integrity of your genealogical data contributions and to avoid errors or omissions in the content. However, you agree that TFA shall neither be responsible nor liable for errors or omissions in any content you may find on this site, nor for loss, damage, or corruption of genealogical data that you submit or post.
Legal Status and Jurisdiction You understand that this Agreement is governed by the laws of the State of Utah, United States of America, without regard to its principles on conflicts of laws. You agree that any legal action you bring against TFA shall be brought in either the state or federal courts located in Salt Lake County, Utah, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. You agree to this regardless of your location or any inconvenience to you.
Severability If any provision of this Agreement is found to be unlawful, void, or unenforceable in whole or in part, the remaining provisions shall be unaffected, unless TFA determines that the invalid or unenforceable provision is an essential term of this Agreement, in which case TFA may in its sole discretion amend this Agreement.
Data Protection If you are located outside the United States, you consent to the processing in the United States of America of any personal data that you submit. You also agree to comply with all applicable laws regarding the transmission of data to or from the United States of America and the country in which you reside.
Limitations of Liability TFA will not be liable for direct, indirect, punitive, special, consequential or other damages resulting from your use of, or your inability to use, genealogical data on this site, the materials in this site, or any website linked to from this site. To the extent that the above limits are found not to be enforceable, in no event shall TFA’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or any linked web site.
